- Sharia Compliance Oversight: Review and approve all financial products, services, and contracts to ensure full compliance with Islamic Sharia principles and Aurum MFI’s operational framework.
- Policy Development: Collaborate with the management team to develop and update Sharia-compliant policies, procedures, and guidelines in line with Central Bank regulations and Islamic finance standards.
- Product Structuring: Provide expert input in designing and structuring new Murabaha, and other Islamic financing products, ensuring they align with Sharia law.
- Board Meetings: Attend regular Sharia Board meetings (monthly) and provide authoritative advice on operational and strategic matters, with additional meetings as required.
- Training and Awareness: Conduct training sessions for staff on Sharia compliance, Islamic finance principles, and Aurum MFI’s ethical standards to enhance institutional knowledge.
- Audit and Review: Participate in internal and external Sharia audits, ensuring corrective actions are implemented to address non-compliance issues.
- Fatwa Issuance: Issue Sharia-compliant fatwas or rulings on complex financial transactions or disputes, documenting decisions for transparency and regulatory reporting.
- Regulatory Liaison: Serve as the primary point of contact with the Central Bank of Afghanistan and other regulatory bodies regarding Sharia compliance matters.
- Risk Management: Identify and mitigate Sharia-related risks in operations, ensuring Aurum MFI remains protected from legal or reputational harm.
- Documentation and Reporting: Maintain detailed records of Sharia Board decisions, submit quarterly compliance reports to the Board of Management, and ensure alignment with Aurum MFI’s governance framework.
- Education: Advanced degree (Master’s or PhD) in Islamic Finance, Sharia Law, or a related field from a recognized institution.
- Experience: Minimum of 5-7 years of experience in Islamic finance, with at least 3 years in a Sharia advisory or board role within a financial institution.
- Certification: Certification in Islamic Finance (e.g., AAOIFI, CISI Islamic Finance Qualification) is highly preferred.
- Knowledge: Deep understanding of Islamic jurisprudence (Fiqh al-Muamalat), Central Bank of Afghanistan regulations, and international Islamic finance standards.
- Skills:
- Excellent analytical and problem-solving skills to address complex Sharia compliance issues.
- Strong communication and interpersonal skills to train staff and liaise with regulators.
- Proficiency in Dari, Pashto, and English (written and verbal) for effective documentation and stakeholder engagement.
- Legal Compliance: Must be willing to work full-time during official hours, as per Central Bank of Afghanistan requirements, with no part-time or out-of-hours arrangements permitted.
- Background Check: Successful candidates will undergo a thorough background and reference check to ensure integrity and suitability for the role.
